Terms of Service

Welcome to Elvan, a product of Starlink Media OPC Pvt Limited (“Elvan,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of Elvan’s website, products, a nd services (collectively, the “Service”). By signing up or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 16 years old and have the legal capacity to enter into contracts. Companies may create accounts and grant access to employees, contractors, or agents.

2. Accounts & Access

  • •You must provide accurate information to create an account.
  • •You are responsible for safeguarding your login credentials and all activity on your account.
  • •Elvan may suspend or terminate accounts that violate these Terms or engage in fraud, abuse, or illegal activities.

3. Service Use

  • •Elvan grants you a limited, non-exclusive, non-transferable license to access and use the Service in accordance with these Terms.
  • •You may create, distribute, and analyze NPS surveys via embed, email, or web link.
  • •You agree not to: reverse engineer the Service; harass others; use the Service for unlawful or prohibited purposes; introduce viruses or malicious code.

4. Subscriptions & Payments

  • •Elvan offers Free and Pro subscription plans. Pro plan fees are billed monthly in advance.
  • •You authorize us to charge your payment method for all fees. Plans renew automatically unless canceled at least five days before the next billing date.
  • •Refund Policy: We offer a minimum 14-day refund window from the date of purchase for new subscriptions, in compliance with Paddle’s seller requirements. After this period, refunds are not guaranteed except as required by law.
  • •All fees are non-refundable except as expressly set forth herein.

5. Intellectual Property

  • •Elvan and its licensors retain all rights, title, and interest in the Service, including patents, copyrights, trademarks, and trade secrets.
  • •You retain ownership of the survey questions and response data you upload or collect via the Service. You grant Elvan a worldwide, royalty-free license to use that data solely to provide and improve the Service.

6. Data Privacy & Security

  • •We implement industry-standard technical and organizational measures to protect your data.
  • •You are responsible for complying with any laws applicable to your survey recipients, including obtaining consent.
  • •See our Privacy Policy for details on collection, use, and disclosure of personal data.

7. Term & Termination

  • •These Terms remain in effect until terminated by you or Elvan.
  • •You may close your account at any time.
  • •Elvan may terminate or suspend your access immediately for cause, including breach of these Terms.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND. ELVAN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELVAN WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA ARISING OUT OF OR IN CONNECTION WITH THE SERVICE.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Bangalore, India.

11. Changes to Terms

Elvan may modify these Terms at any time by posting the revised Terms on the site with a new “Last updated” date. Your continued use constitutes acceptance of the revised Terms.
